Can You Challenge A Driver’s License Suspension?

Yes, you can challenge a driver’s license suspension in Pennsylvania. The process typically involves requesting a hearing with the Pennsylvania Department of Transportation (PennDOT) or the court, depending on the reason for the suspension. Here are some key steps to consider:

  1. Contact an attorney: An experienced attorney can provide guidance, represent you and help strengthen your case.
  2. Request a hearing: If you believe the suspension is unjustified or there are mitigating circumstances, you can request a hearing. For DUI-related suspensions, PennDOT typically conducts these hearings.
  3. Prepare your case: Gather all relevant evidence and documentation . This can include proof of payment for fines, evidence of completed requirements, such as DUI programs, or any other supporting information.
  4. Attend the hearing: Present your case at the hearing, providing any evidence and arguments as to why the suspension should be lifted or modified.

If a judge makes a decision that is not in your favor, you have the option to appeal. If you wish to appeal, I can assist you through every step of the process.

Your Options To Reinstate Your License

When you’re facing a license suspension, I can help you navigate the process to get it reinstated. Here are a few different ways you could do so:

  • Agree to install an ignition interlock device on your vehicle
  • Apply for an occupational limited license (if you are eligible)
  • Appeal your suspension in court

Your ability to pursue these options can depend on your specific circumstances. If you have any additional questions, please do not hesitate to reach out.

Can You Get A Hardship Or Occupational License During Suspension?

In Pennsylvania, obtaining a hardship or occupational license during a suspension is generally not an option. Pennsylvania does not offer a specific “hardship” or “occupational” license for those whose licenses have been suspended due to DUI or other offenses. However, there are limited circumstances where you might be eligible for a different type of restricted license, such as if you agree to putting an ignition interlock device on your car.
