A man has been accused of driving while drunk on the way to a court appearance for a previous DUI, according to sources. The 66-year-old man was charged with drunk driving back in November, but was apparently arrested by Pennsylvania authorities on his way to face those charges for another drunk driving charge. He is likely focused on preparing his criminal defense to both DUI charges at this time.
According to the police report, the man was arrested around noon on Feb. 23 when he was pulled over by police for suspicion of drunk driving. There is no record as to what actually prompted police pulled him over, but apparently a field sobriety test as well as a breath test were administered on-site. The man reportedly failed those tests and was subsequently arrested.
The man was taken to a local hospital for a blood test to corroborate his allegedly intoxicated state. The results of the test are unknown as of this report, but apparently it was enough for police to arrest the man for DUI as well as driving while suspended/DUI related. It is not clear whether he remains in police custody or if he has been released at this time.
Alcoholism is a serious disease, one from which the accused man may suffer. While Pennsylvania drunk driving charges are serious, the man’s criminal defense representation may choose to highlight his unfortunate affliction during the criminal proceedings to in an effort to sway the court to act with leniency, conditioned on the man getting the help to appears to need. If the man agrees to court-mandated rehabilitation, it may be possible for his team to achieve a reduction in charges and/or a reduced sentence. Of course, as with any criminal charges, the man also has the right to deny the formal accusations and force prosecutors to actually prove them at trial and beyond a reasonable doubt.
